1. About ClueGo and these Terms
These Terms and Conditions ("Terms") govern access to and use of the services offered by ClueGo (Zancanaro Beatrice, VAT IT04046990364, Via Sestri Levante 40/5, 41125 Modena, Italy) through the website www.cluegovisit.com.
ClueGo provides interactive, self-guided digital city trails accessible via a browser-based Web App (the "Service"). By purchasing a trail, you agree to be bound by these Terms.
"User" means any individual who purchases or uses a ClueGo trail.
2. Purchase and access
Once payment is complete, you will receive an access code and a link to the Web App by email. Access is immediate and does not require registration or downloading an application.
Purchases are intended for adults (18+) or for minors under adult supervision. By purchasing, you confirm that you have the legal capacity to enter into a contract, or that you are doing so on behalf of a minor for whom you accept full responsibility.
3. Licence
ClueGo grants you a personal, non-exclusive, non-transferable, non-sublicensable licence to use the purchased trail solely for personal, non-commercial purposes.
4. Prohibited uses
The following are strictly prohibited:
• Copying, reproducing, distributing or publishing trail content (texts, puzzles, images, maps) by any means
• Sharing your access code with anyone outside your playing group
• Using the Service for commercial purposes or for profit without prior written authorisation from ClueGo
• Reverse engineering, decompiling or attempting to extract the source code of the Web App
• Using the Service in a way that causes harm to third parties or violates applicable law
5. Intellectual property
All content on the website and within ClueGo trails — including but not limited to texts, puzzles, images, logos, graphics, maps and software code — is protected by applicable copyright law and belongs to ClueGo or to the respective creators with whom ClueGo has entered into licence agreements.
Any unauthorised use constitutes an infringement and may be subject to legal action.
6. Licence duration and expiry
Each purchased trail is valid for a maximum of 6 (six) months from the date of purchase, or 10 (ten) days from the date of first activation (i.e. when you start playing), whichever occurs first.
Example: if you purchase a trail on 1 January, you have until 1 July to start playing. Once you start, you have 10 days to complete it.
After expiry, your access code will no longer be valid. ClueGo is not obliged to extend the validity period, except in exceptional circumstances assessed on a case-by-case basis.
7. Limitation of liability
The Service is provided "as is". ClueGo endeavours to ensure the Web App functions correctly, but accepts no liability for:
• Temporary service interruptions due to maintenance or technical issues
• Connectivity issues attributable to your device or mobile carrier
• Any injury, loss or damage sustained while carrying out a trail, as trails take place in public spaces under your sole responsibility
• Indirect, incidental or consequential damages arising from use of the Service
ClueGo is not responsible for the physical availability of locations referenced in trails (e.g. temporary closures of monuments or areas).
Nothing in these Terms limits any rights you may have under applicable mandatory consumer protection law, including the EU Consumer Rights Directive 2011/83/EU.
8. Minors
ClueGo trails are suitable for minors accompanied by an adult. The accompanying adult is responsible for the minor's safety throughout the activity.
9. Payment
We accept the following payment methods:
• Credit or debit card via Stripe
• PayPal
• ClueGo gift voucher redemption
All prices shown on the website are inclusive of applicable VAT. ClueGo reserves the right to change prices at any time; changes will not apply to purchases already completed.
10. Changes to these Terms
ClueGo reserves the right to update these Terms at any time. Changes will be published on this page with a new effective date. Users subscribed to the newsletter will be notified of material changes by email. Continued use of the Service after publication of changes constitutes acceptance of the updated Terms.
11. Governing law and jurisdiction
These Terms are governed by Italian law. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Modena, Italy, except where applicable mandatory consumer protection law provides otherwise.
If you are a consumer resident in the European Union, you may also benefit from the mandatory consumer protection provisions of your country of residence.
